These Terms of Use and any associated terms (the “Terms”) govern your (“User”, “you”) use of the Services provided by bitsz.io (the “Website”), including technology, integrated platforms, and related applications (e.g., mobile apps). All references to the “Services” in these Terms apply to platforms operated and maintained by Bitsz (“We”, “Us”, or “our”).

By accessing the Website or using the Services, you agree to be bound by these Terms.

1. Enforcement and Amendments

1.1 These Terms constitute a binding agreement between Bitsz and you upon accessing the Website. By using the Services, you confirm that you have read and fully accept these Terms.

1.2 The Terms may be updated periodically at our sole discretion. If you do not accept these Terms in full, you must discontinue using the Services immediately.

1.3 We reserve the right to modify these Terms at any time without prior notice.

2. Services Provided

2.1 The Services allow you to exchange one type of cryptocurrency for another.

2.2 For the purposes of this agreement, “Exchange” refers to the process of swapping one cryptocurrency for another, facilitated through third-party platforms and subject to associated fees. Exchange rates displayed within the Services are for reference and may not always align with rates on other platforms.

2.2.1 Fixed rate: Our fee will be 1% + network fee. No hidden fees. The rate is frozen for 12 minutes. If the market rate changes by more than 1.3% before the transaction is detected in the blockchain network, you will be offered either a refund or to proceed with the exchange at the market rate.

2.2.2 Floating rate: Not fixed until the funds are received and the exchange transaction is completed. Our fee is 0.5% + network fee. The exchange is carried out at the market rate – no hidden fees.

2.3 “Cryptocurrencies” are digital assets transferred exclusively via blockchain technology, such as Bitcoin, Ethereum, and other tokens, which are not tied to traditional securities.

2.4 Each transaction is assigned a unique address by the system, capturing user details, crypto pair preferences, and recipient wallet addresses.

2.5 YOU RELEASE BITSZ FROM LIABILITY FOR ANY ERRORS RESULTING IN LOSS, INCLUDING INCORRECT ADDRESSES OR TRANSACTIONS INITIATED BY USER MISTAKES.

2.6 Bitsz does not provide custodial services for cryptocurrencies. Transactions may be delayed due to compliance reviews or technical issues. By using the Services, you accept the possibility of such delays.

2.7 AML and KYC checks are mandatory for certain transactions and users. Bitsz reserves the right to request identification documents and validate the source of funds. Third-party providers may assist in executing these checks while adhering to data privacy regulations.

2.8 Bitsz reserves the right to suspend or deny Services to individuals suspected of engaging in unlawful activities.

2.9 Exchange rates for both fixed and floating options may vary. Users are required to understand the associated terms and conditions before initiating transactions.

2.10 If the exchange direction involves a floating rate, it is recalculated only downward. The executor is not responsible for or bears expenses for transaction delays on the client’s side.

3. User Responsibilities

3.1 The Service is not provided to, and is not intended for, persons who are citizens, residents or tax residents of, or who are located, incorporated or established in, or acting from, the member states of the European Union and the European Economic Area (all 27 EU member states, as well as Norway, Iceland and Liechtenstein; the “EU/EEA”). Such persons may not create an account, complete verification or use the Service.

3.2 Users affirm they are not located in or residents of the EU/EEA (as defined in Section 3.1 above) or jurisdictions restricted by international sanctions or legal prohibitions.

3.3 By using the Service, the User represents and warrants that they are not a citizen, resident or tax resident of the EU/EEA, are not located in the EU/EEA, are not incorporated or established in and do not act from the EU/EEA, and do not act in the interest of or on behalf of such persons. These representations are deemed to be repeated each time the Service is used.

3.4 Users agree not to:

  • Misuse the Services for illegal activities;
  • Submit falsified or misleading information;
  • Tamper with, reverse-engineer, or decompile the platform’s software;
  • Utilize unauthorized automated tools to access Services.

3.5 The Company may, at any time and without giving reasons, refuse access, suspend or block access, refuse to execute a transaction, and terminate the relationship with the User where indicators of a connection to the EU/EEA are detected (including by IP address, geolocation, payment attributes or verification data). The use of VPNs, proxy servers, anonymisers or any other means of circumventing territorial restrictions is prohibited and constitutes an independent ground for blocking and termination.

3.6 The Service is not directed at the EU/EEA; the Company does not carry out, and does not procure any third party to carry out, any marketing, advertising or promotion of the Service addressed to persons in the EU/EEA. The provision of services to a person connected with the EU/EEA is possible solely at that person’s own exclusive initiative. The Company does not offer or promote to such person any other services or crypto-assets, including of the “same type”, outside the specific transaction initiated by that person.

3.7 USERS AGREE TO RELEASE BITSZ FROM CLAIMS ARISING FROM NON-COMPLIANCE WITH THESE TERMS.

3.8 Affiliates must not market, promote, advertise, distribute links, target keywords, run paid campaigns or otherwise solicit users located in or resident in the EU/EEA. The Company may reject referred traffic, cancel commissions and terminate the affiliate relationship where the affiliate targets or refers EU/EEA users.

4. Third-Party Content and Services

4.1 Third-party content may be accessible through the Website. Bitsz does not guarantee the accuracy or legality of such content and is not responsible for any transactions conducted through third-party platforms.

4.2 Third-party fees are independent of Bitsz, and users assume full responsibility for compliance with external service terms.

5. Intellectual Property

5.1 All intellectual property related to the Services, including designs, trademarks, and code, remains the exclusive property of Bitsz.

5.2 Users may access and utilize the Services for personal use but are prohibited from modifying or redistributing proprietary materials.

6. Limitation of Liabilities

6.1 The Services are provided on an “as is” basis, without warranties of any kind.

6.2 Bitsz shall not be held liable for losses resulting from:

  • Technical interruptions or failures;
  • User errors in transactions;
  • External events outside our control.

6.3 Users accept full responsibility for verifying transaction details before submission.

7. General Provisions

7.1 These Terms encompass the entire agreement between users and Bitsz.

7.2 In case of discrepancies between these Terms and other agreements, these Terms shall prevail unless explicitly superseded.

7.3 The invalidity of any provision does not impact the enforceability of remaining sections.

7.4 Users may not transfer their rights under these Terms without prior consent. Bitsz reserves the right to transfer its rights without notice.

By continuing to use the Services, you acknowledge and agree to the full extent of these Terms.
